English: Indemnity Act an Act ratifying all the orders, directives, ordinances of the martial law government. With the assassination of President Sheikh Mujibur Rahman on 15 August 1975 in the hands of some army personnel, the army asserted influence in state power directly or indirectly, and Khondaker Mostaq Ahmad was installed as President of the country.
Subsequently, after the November 7 uprise of soldiers and people Lieutenant General Ziaur Rahman took over the state power. Ziaur Rahman issued some orders and directives, and later got them ratified in the jatiya sangsad. The Act was passed in the Sangsad with an object of keeping the question of legality of martial law beyond the jurisdiction of the court. To legalise all the activities of the government and all the promulgated military rules and orders during the period from 15 August 1975 to 9 April 1979 the Indemnity Act was incorporated in the constitution as Fifth Amendment Act 1979 during the rule of General Ziaur Rahman. The second Indemnity Act was passed in the Sangsad on 10 November 1986 to legalise all the military rules, orders, ordinances and directives of the military government of General Hussain Muhammad Ershad promulgated during the period from 24 March 1982 to 9 November 1986. The Second Indemnity Act was incorporated in the Seventh Amendment of the Constitution. The Indemnity Act appeared to maintain continuity of governmental activities, and it was used as an instrument to rebut from military to constitutional rule. It is considered to have been the safeguard for the military rulers since it offers legality to their unconstitutional activities. The government of Sheikh Hasina placed a bill before the Jatiya Sangsad on 12 November 1996 for the annulment of the Indemnity Ordinance 1975 (Ordinance No. 50 of 1975). The bill was passed in the Sangsad without any opposition, and it was ratified by the President on 14 November 1996. |
