[edit]Asks $10,000 Damages. Pilot Sues Airplane Manufacturer for False Arrest. Buffalo, New York; January 27, 1928. Gordon K. Berry, former Royal Canadian Air Force pilot, has filed suit in Supreme Court here for damages of $10,000 against Cleburne Eberhart, Jr., aeroplane manufacturer. Berry charges he was falsely arrested on Eberhart's complaint. The arrest followed an aeroplane crash at Hamburg last September in which two passengers, who were in the Berry plane with Berry, were injured. After the accident, Berry was arrested and a charged with grand larceny presented to a grand Jury, which did not return an indictment. Eberhart, who is president of the Eberhart Aeroplane and Motor Co., of this city, owners of the plane, explained today that he made the charge "to protect myself against possible civic action by the men who were almost killed." The case is not expected to come to trial for several months.
