It is probably not in the public domain in the U.S. The painting is the work of a Belgian artist. As a non-U.S. work that was still copyrighted in its source country (Belgium) in 1996, it was subject to the copyright restorations of the Uruguay Round Agreements Act in the U.S. Its copyright in the U.S. was thus restored in 1996, and thus the painting is copyrighted in the U.S. We do not know exactly when this painting was created (1924 appears to be wrong as the subject died on August 18, 1923).
