Therewas a decree against the company, grantingsubstantially the relief prayed for by theUnited States; and on an appeal by the com-pany to the Supreme Court it was held thatwhile the holding company was not directlyengaged in interstate commerce it was in factformed for the purpose of carrying out 9,scheme to so manage the two railroad com-panies as that they should cease to be compet-ing carriers in interstate commerce and thatunder the Sherman Anti-trust Act (see) it wasa combination in restraint of such commerceand illegal. Four of the justices concurred inthe view that any combination extinguishingcompetition between otherwise competing rail-roads engaged in interstate commerce was il-legal under the Sherman Act, and another jus-tice concurred in the result upon the groundthat although the act was only directed against 560 NORTHERN SECURITIES CASE

The Northeastern Boundary Controversy unreasonable and unlawful combinations, thescheme which the defendant corporation wasformed to carry out was in fact under thecircumstances within the prohibition of thestatute.
