procurement of the indictments against Klockand Gaylord. The trial upon the indictment against Charles A. Klock was held inJune, 1907, before the County Court of Oneida county, Judge Pritchardpresiding, and the defendant, Klock, was discharged by the Court at closeof the evidence for the reason that there was not sufficient testimony tojustify his conviction as matter of law, the money which the indictmentcharged was the subject of the larceny, being paid the defendant by Gal-lagher, a particeps criminis for the purpose of completing an illegal andunlawful transaction to defraud the State of New York of its property andthat Gallagher was chargeable with knowledge of the fact that it wasunlawful. The opinion of Judge Pritchard is reported in full in 55 Misc. Reports,at page 46. On April 1, 1907, James Gallagher, George Vincent, William H. Syphertand Albert Harrig were indicted by the Grand Jury of Herkimer countyfor grand larceny, first degree, for the wrongful and unlawful obtaining,

FOREST, FISH AND GAME COMMISSIONER. 387 appropriating and stealing of the softwood timber cut and destroyed bysaid parties upon the State land in Nobleboro Patent. Trials upon the indictments against James Gallagher and Syphert andHarrig were thereafter had before the County Court of Herkimer county,all of said defendants being acquitted by the verdict of the juries. Further investigation of the official conduct of Protectors Klock andGaylord, brought to light a course of transactions criminal in their natureupon their part, whereby they, had defrauded the State of a considerablesum of money received by them in settlement of cases for violations ofthe statute. These matters were presented to the Grand Jury of Herkimercounty and indictments charging Klock and Gaylord with grand larcenywere presented. The trial of these indictments resulted in the convictionof both Klock and Gaylord, who were sentenced to State prison for a termof not less than one and a half or more than three years. K
