lexities. The most prolific source of disturbance andapprehension is the frail legal tenure by whichthe Indians hold their lands. It has been theunvarying practice of our Congress and courtsto treat these titles as rights of occupancy,merely, on the part of the tribes as tribes,without privilege of division or alienation,save with the consent and cooperation of theUnited States. This exposes them to contin-ual question, and invites attempts to annulor contravene them. Already, an organizedmovement, known as the Oklahoma boom,has been made to seize and colonize a largebody of the territorial lands, on the groundthat the Seminoles, having transferred saidlands to the United States in compliance withdesire to locate other Indians thereon. theybecame ipso facto public lands, subject to home-stead and preemption entries, in so far as theywere not really allotted to other Indians;that is to say, the Seminole title of occu-pancy having been extinguished by this trans- 6o4 THE INDIAN COUNTRY.

This movement has embraced atone time and another several hundreds of fam-ilies, encamped on the Kansas border, withstock and tools, arms and provisions, awaitinga favorable chance to elude military surveil-lance and push over into the Territory. Infact, small parties have several times succeededin reaching the lands in question,— on theNorth Fork of the Canadian River, just westof the Sac and Fox reservation,— and havebeen arrested and ejected therefrom by thetroops. The leader of the enterprise was triedat the May term, 1881, of the United Statescourt for the western district of Arkansas, andconvicted of having unlawfully entereil theTerritory, for which he was fined $1000.
