Reason for the nomination: These images were both sourced from a webpage of the US National Weather Service but are attributed to a third-party photographer, who is an NWS employee. The personal attribution, together with the separation of Mr Crowley's photos from NWS Norman photos on the parent page,[1], as well as the fact that aerial photos taken by the NWS are practically unknown, creates significant doubt whether this photo was taken as part of the employee's official duties. According to a 2002 article in Weather and Forecasting, the photos were taken by Mr Crowley and a John Jarboe (connected to both the NWS and FAA), but does not provide any evidence one way or another about whether these people were on duty or who paid for the flight. For many years, hosting such images on the Commons was done in good faith under the rationale that:
An extensive review of this rationale in 2024 revealed that neither of these beliefs held up to scrutiny. These findings were confirmed in an RfC conducted from August to October 2024. As part of this review, I have investigated several images attributed, like this, personally to NWS employees, and in every case, the image has turned out to be the employee's personal property, to which they claim copyright. Although it is certainly possible that this image was created while on duty, it would be a highly unusual exception. Per COM:ONUS it is the responsibility of the person uploading an image to the Commons or anyone arguing for its retention here to provide evidence of permission from the copyright holder. Nevertheless, I reached out to the NWS Norman office that published the photos (October 2) but I have received no response. I forwarded this attempt at contact to the VRT: (ticket:2024110410009811) As images created in the US after 1989 and attributed to a creator eligible for copyright, these are presumably unfree files and we must delete them as a precaution under COM:PRP.
